Anambra: UPP set to drag Governor Obiano to court

The Anambra State chapter of the United Progressive Party on Friday asked Governor Willie Obiano to reverse the appointment of local government caretakers he made into the 21 councils areas of the state.

According to the UPP, failure to do so within seven days would force them to drag him to court. The party said the council appointments were contemptuous of a pending court ruling on the matter.

In a statement in Awka, the capital, UPP spokesperson in the state, Mr. Uche Amaku, reminded the governor that a member of the party, Mr. Ifeanyichukwu Okonkwo, had in September 2006 obtained an order of perpetual injunction against the Governor of Anambra State, the State House of Assembly and Attorney General and Commissioner for Justice from setting up a caretaker committee, arguing that the order was still in force.

He said by going ahead to set up and inaugurate caretaker committees for the 21 local government councils on March 29, 2017; the governor’s action not only amounted to a slap on the face of a subsisting court order but also amounted to flagrant breach of the positive order.


He said: “The judgment in suit No FHC/EN/CS/90/2005 between Mr. Ifeanyichukwu Okonkwo Vs Federal Government of Nigeria and 3 others, which as yet has no stay of execution or injunction, was clear and unambiguous.

“The court presided over by Justice A. L. Allagoa had declared that by the combined effects of section 7(1) and 318 (1) of the 1999 Constitution of the Federal Republic of Nigeria as amended, the Governor of Anambra State has no power for the appointment and approval of caretaker management committees or in whatever name so called, to administer respectively the 21 local government council areas in Anambra State.

“We wish to also remind Governor Obiano that on March 17, 2014 he swore to protect and defend the constitution of the Federal Republic of Nigeria, when he took the oath of allegiance and oath of office of Executive Governor of Anambra State.

“We advise him to reverse his latest unconstitutional act of impunity within the next seven days or be prepared to meet our lawyers in court for committal proceedings.”
